BOARD MEETING MINUTES
July 14, 2010
Chairman, Kevin Behnke called our July town board meeting to order on Wednesday, July 14, 2010, at 7:00 p.m . Roll call was taken: Kevin Behnke, Chairman; John H. Karbon, Jr., Supervisor; Donald Schuette, Supervisor; Joe Janowski, Zoning Administrator; Paulette, Vogt, Treasurer, Ed Downing, Road Supervisor; ValJean Marcoe, Law Enforcement Officer; Barbara Pankratz, Clerk, Joe Denor, Assessor, Mark Knorr, Bernie Vogel, Wendy Peters and Mark Weisbrook were present. Everyone joined in reciting the Pledge of Allegiance.
The clerk verified the posting of the agenda in the three designated public places and affidavit of posting for this meeting after which motion was made by John H. Karbon, Jr., Supervisor to approve the agenda. Motion was seconded by Donald Schuette, Supervisor and passed.
The minutes of the June, 2010 meeting were accepted by motion made by John H. Karbon, Jr. and seconded by Donald Schuette. Motion carried.
Donald Schuette made a motion to accept the treasurer’s report as submitted. John H. Karbon, Jr., seconded the motion which carried.
Chairman Behnke opened the public in-put session of the Board Meeting. Wendy Peters, who resides in Valley View Court Subdivision informed the Board that paving/chipsealing had been done on her road but that the contractor was not able to continue the work because there was gravel on the road in the cul de sac. She was inquiring as to whether or not the contracting company was going to return and whether or not there was an extra charge if they did. Ed Downing, Road Supervisor will take care of this matter.
Mark Weisbrook of Clover Road stated to the Board that he had a water problem at the corner of Gass Lake and Clover Road behind his building. There is not much of a slope and he thought that a culvert would help the situation. At present there is a three inch berm and he did not know that would be enough for a culvert. He was told that thirty-three feet from the center of the road drainage issues are the town’s responsibility. Mr. Weisbrook stated that water from the West and North comes into his property. Chairman Behnke informed Mr. Weisbrook that Road Supervisor Ed Downing and Supervisor Don Schuette would look at the culvert and bring the information back to the Town Meeting which would decide whether the Town is responsible for the water issue.
Mark Knorr appeared before the Board to inform them about a problem with rodents, raccoons and cats inhabiting his neighbor’s property. Mr. Knorr indicated that he had contacted Mr. Blaha from the Health Department and making him aware of the situation. Mr. Knorr was told that our Law Enforcement Officer, ValJean Marcoe, is contracted to take steps with working with County Officials to alleviate this issue.
There being no further public in-put said session was closed.
The next item addressed was the variance issue involving 4301 Valley View Court. Wendy Peters presented a letter and accompanying papers in reference to this matter. Chairman Behnke indicated that the matter will be looked into and hopefully the issue can be resolved.
Joe Janowski, Zoning Administrator, gave an update on a letter dated July 8, 2010 that he had received from Gary Truettner in reference to assessment procedures on Mr. Truettner’s property. After discussion it was determined that the issues raised on the assessment of the two acres is an assessment issue which is up to the procedure of the Board of Review and also the second question of partial assessments which is not a Plan Commission/Town Board mandate as much as the assessor following the State law of the State Assessment Code.
Ed Downing, Road Supervisor, gave a report on road work completed. Mr. Downing was told not to cut ditch grass until he had to.
In reference to the South 26th Street matter it was decided that the compensation repair as requested has been dropped and the Town will patch the damage on South 26th Street and Clover Road will be viewed as a possible asphalt project for 2011.
Motion was made by Donald Schuette, Supervisor to pass the ordinance regulating the solid fuel-fired outdoor heating devices. Motion was seconded by John H. Karbon, Supervisor .
Motion passed.
Kevin Behnke made a motion to accept the ACE Builders quote of $4284. in reference to taking wall out on the roof. Ed Downing will check out the bracketing. Donald Schuette seconded the motion which carried.
The radio frequency license was received by Kevin Behnke and the radio project is continuing to be worked on.
The Town hall renovation was discussed. Ron Mrotek will do the remodeling.
At a meeting with members of the Fire Department , Kevin inquired as to what their
vision was for future vehicles.
We will start working on the 2011 budget and Kevin asked Ed and anyone else to bring requests for the budget to the August meeting.
Kevin made a motion that we notify the County to black top a one inch mat on the West end of Orchard Lane at an estimated cost of $21,260. Donald Schuette seconded the motion which carried.
The statements and statement report were submitted to the Board and approved.
John H. Karbon, Jr. made a motion that our July meeting be adjourned which motion was seconded by Kevin Behnke.
